FlareDial
TCPA & DNC Compliance

Zero Legal Exposure on Every Campaign

Automated DNC scrubbing, real-time opt-out processing, STIR/SHAKEN attestation, and full TCPA audit logs — built into every FlareDial plan, not sold as an add-on.

The Stakes

Non-Compliance Is Not a Risk — It's a When

The FTC and plaintiff attorneys are increasingly aggressive. A single campaign running non-compliant dials can trigger class action exposure that shuts down your entire operation.

$500–$1,500
per call

TCPA Violations

The Telephone Consumer Protection Act carries statutory damages of $500 per violation, tripling to $1,500 for willful violations. Class action suits in this space routinely result in seven-figure settlements.

$10,000+
per state per violation

State DNC Violations

States like Florida, Indiana, and Texas operate their own Do Not Call registries with their own penalty structures — separate from and in addition to the federal FTC DNC list.

100%
answer rate loss

Carrier Blacklisting

Major carriers (AT&T, Verizon, T-Mobile) can permanently blacklist outbound numbers — or entire number blocks — flagged for spam behavior. Recovery is months-long and not guaranteed.

How We Protect You

Six Layers of Compliance Protection

Every layer is automated, real-time, and enabled by default for all clients.

Real-Time DNC Scrubbing

Every number is checked against federal, state, and internal suppression lists before every single dial. Zero queuing delay — the scrub happens inline with the dialing algorithm.

Automated Opt-Out Processing

When a contact requests removal, they're added to your suppression list in real time — across all active campaigns simultaneously. No lag, no manual exports.

STIR/SHAKEN Attestation

All outbound calls are signed with full-A attestation where eligible, reducing the likelihood of carrier spam flags and improving answer rates by up to 12%.

TCPA Audit Logs

Every call is logged with timestamp, disposition, agent ID, and the DNC scrub result at dial time. Exportable in CSV, JSON, and PDF for legal discovery.

Number Health Monitoring

Continuous monitoring of every outbound DID against major carrier spam databases. Instant alerts when any number is flagged — before it impacts campaign performance.

Consent Tracking

Track and store consent records with timestamps and source documentation. Link consent records directly to contact records and call logs for a complete compliance trail.

Compliance FAQ

Technical answers to the questions your legal team will ask.

Are you TCPA compliant out of the box?

FlareDial ships with real-time DNC scrubbing, automated opt-out processing, TCPA audit logs, and STIR/SHAKEN attestation enabled by default for all clients. These are not optional add-ons — they are standard features. However, TCPA compliance also depends on how your team obtains consent and manages contact lists. We handle the dialing infrastructure side; your legal counsel should review your consent acquisition practices.

Which state DNC lists do you scrub against?

We scrub against all active state-operated DNC registries including Alabama, Alaska, Arkansas, Colorado, Florida, Georgia, Idaho, Indiana, Kentucky, Louisiana, Massachusetts, Michigan, Mississippi, Missouri, Montana, Nevada, New Jersey, New York, North Carolina, North Dakota, Oklahoma, Oregon, Pennsylvania, Tennessee, Texas, Utah, Virginia, Wisconsin, and Wyoming — plus the federal FTC DNC list.

How quickly are opt-outs processed?

Opt-outs are processed in real time — within seconds of the agent marking the disposition. The number is added to your internal suppression list immediately and is excluded from all subsequent dials across all active campaigns.

What is STIR/SHAKEN and do I need it?

STIR/SHAKEN is an industry-wide framework for authenticating caller ID. Signed calls receive 'full attestation' (an 'A' certificate), which carriers use to allow calls through without spam labeling. Yes — you need it. Calls without STIR/SHAKEN attestation are increasingly being labeled 'Spam Likely' or blocked outright by major carriers.

Can I export audit logs for legal discovery?

Yes. All call records, DNC scrub results, opt-out events, and agent dispositions are exportable in CSV, JSON, and PDF format. Records are retained for a minimum of 5 years and are available on demand from your client portal.
